1. Who we are
This website is operated by Fusion Net Limited, a private limited company incorporated in Bangladesh on 10 January 2010 under the Companies Act, 1994, holding BTRC licences as an Internet Service Provider and an IP Telephony Service Provider.
2. Scope of these terms
These terms govern your use of this website and the information published on it. They do not, by themselves, constitute a contract for services. Services are provided under a separate Master Service Agreement, Service Level Agreement and Order Form executed between Fusion Net Limited and the customer. Where those documents conflict with anything on this website, those documents prevail.
3. Information on this site
Service descriptions, capabilities, coverage and performance figures published here are indicative and provided for general information. Availability at any specific address, and the commercial and technical terms applicable to it, are confirmed only after a site survey and in a written quotation. Nothing on this website is an offer capable of acceptance.
4. Service levels
Availability targets referred to on this website, including the 99.9% network uptime target, describe our engineering objective for the network. Contractual service level commitments, measurement methodology, exclusions, escalation procedures and any service credits are defined in the Service Level Agreement applicable to each customer and service.
5. Acceptable use
Customers must not use our services to transmit unlawful material, to infringe intellectual property, to distribute malware, to conduct unauthorised scanning or intrusion against third parties, or to send unsolicited bulk communications. We may suspend service where use threatens network integrity, breaches applicable law, or violates the conditions of our licences.
6. Intellectual property
The content, design, marks and code of this website belong to Fusion Net Limited or its licensors. Third-party names and marks appearing on this site remain the property of their owners and are used for identification only. Nothing here grants a licence to use any mark.
7. Third-party links
Links to external sites, including those of group companies, are provided for convenience. We do not control and are not responsible for their content or practices.
8. Limitation of liability
To the extent permitted by law, we exclude liability for loss arising from reliance on information published on this website. Liability in respect of contracted services is governed exclusively by the relevant service agreement. Nothing here excludes liability that cannot lawfully be excluded.
9. Privacy
Personal data submitted through this website is handled in accordance with our privacy policy.
10. Governing law
These terms are governed by the laws of Bangladesh, and the courts of Bangladesh have exclusive jurisdiction over any dispute arising from them.
11. Changes
We may update these terms. The date at the top of this page records the most recent revision.
